ACCOMMODATION REGULATIONS and RENTAL CONDITIONS - VILLA MAGNOLIA
Located in Saint-Léonard-de-Noblat (Fr.), Moissannes - Le Maurin 2 - 4
1) Glossary
The holiday residence: includes the house, its contents, the swimming pool, the garden and the parking lot which are part of the rented property as mentioned above;
The lessor: Wim and Rino WOUTERS-MICHIELSEN, Schoolstraat 56, 2260 Heultje Westerlo; Belgium.
The tenant: the tenant is understood as the group that rents the holiday accommodation for a well-defined period and for which the signatory of the rental contract assumes joint and several liability.
The rental period: the specific period during which the property is made available to the tenant.
2) Reservation
AT.The contract concerns the rental of the holiday home for recreational purposes, which by its nature is of short duration.
B. Only reservations made by persons over the age of 18 will be accepted.
C. Within 5 days of the reservation request, the provisional confirmation follows, as well as the general rental conditions and the invoice. These documents can then be reviewed. Any comments should be reported as soon as possible. If the tenant has not received a response within 10 days of the reservation request, he must contact the owner. The contract only becomes final when the deposit (25%) is paid.
D. The contact person who sent the rental agreement and invoice acts on behalf of the group. He assumes full responsibility on behalf of the tenants and must inform all other tenants of the existence of this contract and the rules of procedure.
E. The rental ends automatically at the end of the agreed period.
3) Payment
A. Payment will be made as follows: - 25% of the rent within 14 days of the invoice date; - 75% of the rent and the deposit 6 weeks before the date of arrival; - 100% of the rent and the deposit if the reservation period is less than 6 weeks before the arrival date. This amount must be paid immediately at the time of booking.
B. Payment(s) must be transferred to Villa Magnolia's account number IBAN: BE55 9731 8659 9944 indicating the invoice number and rental period.
C. With payment, the tenant confirms his agreement with the general rental conditions.
D. In the event of late payment, a formal notice will be sent, after which the lessor reserves the right to cancel the reservation and dissolve the contract while respecting the cancellation conditions set out in this contract (chapter, etc.) .
4) Additional costs
A. Cleaning:the cleaning costs amount to € 120.00 (if the house is rented for 6 people) OR € 180.00 (if the house is rented for more than 6 people); if excessive soiling and/or disorder leads to additional cleaning work, these additional hours will be charged at € 25.00/hour.
B. Energy: Charges for daily use of electricity, water and internet are included in the rental price. Exponential consumption will be charged (for example, charging an electric vehicle). Electric meter readings will be noted on arrival and departure.
C. Linen rental package: bed linen rental is €9.00 per person.
D. Two towels are provided free of charge per person. Tea towels and kitchen towels are also available.
E. Tourist tax: The tourist tax is borne by the owners and is therefore included in the rental price.
F. Delays:if costs are incurred because the property is not available at the agreed time, they will be recovered from the tenant.
G. Forgotten items: the lessor is not responsible for equipment left behind. This material will be retained for a reasonable period. The costs related to sending by post will be borne by the tenant.
5) The deposit
A. The deposit amounts to €500.00. This sum will be used in the event of damage and/or possible costs in the holiday accommodation.
B. The deposit must be paid at the same time as the second payment of the rent. If the deposit is not paid, the lessor has the right to refuse access to the holiday accommodation and to withdraw from the contract.
C. The deposit will be refunded within 14 days of departure, after deducting any damages.
D. Any (other) claims for damages are not extinguished by this reimbursement.If the damage exceeds the amount of the deposit, the tenant agrees to reimburse the damage within 14 days of notification of the compensation claimed.
6) Cancellation
Cancellation by the tenant must always be made in writing (or by e-mail). The following rules apply: - If canceled up to 6 weeks before the date of arrival, 25% of the rent will be charged. - In case of cancellation up to 3 weeks before the date of arrival, 50% of the rent will be charged. - In case of cancellation up to 1 week before the date of arrival, 75% of the rent will be charged. - In case of cancellation between 7 days and the day of arrival, 100% of the rental amount will be charged. - If within 24 hours of the agreed date - without further notice - the holiday home is not occupied, this is considered a cancellation and the full rental amount is due. - In the event of cancellation by the owner, all sums paid will be refunded.
7) Receipt of the key
After payment of the total amount of the invoice, the tenant will receive the code of the key safe in which he will find the key of the house one week before the date of arrival (by e-mail or by SMS). This code cannot be transferred or modified. The tenant does not have the right to keep or duplicate the key for any reason whatsoever, under penalty of a fine of €50.00 without prejudice to the actual costs. In case of loss, theft,... an amount of € 50.00 will also be charged.
8) Stay in the holiday home
Periods: A. Weekend: Saturday from 4 p.m. to Monday 10 a.m.
B. Midweek: Monday 4:00 p.m. to Friday 10:00 a.m.
C. Week: Saturday from 4 p.m. to Saturday 10 a.m. -
The maximum occupancy of the property is 14 people. - Subletting is expressly prohibited. - The stay of a number of people greater than that agreed in the reservation is not permitted, unless otherwise agreed in writing.In this exceptional case, a fee will be charged (€15.00 per person per night). - For organizational reasons, it is requested to inform the owners of the arrival time the day before. - In high season (June to September), the holiday home is only rented by the week.
9) Accommodation
A. Please treat the holiday home and its contents with care so that future guests can also fully enjoy this beautiful holiday home.
B. All items in or belonging to the holiday home may be used in the manner for which they are intended. In all cupboards and drawers in the kitchen there is a clear list/picture to help find (and also store) the necessary materials.
C. Please do not move the furniture from one room to another: this is to avoid possible damage and wear and tear on the furniture, floors and walls.
D. Please leave tablecloths on dining tables.
E.Please do not use/spillage acid-containing substances on the kitchen island to avoid damage.
F. It is forbidden to use a fryer or a gourmet inside the residence.
G. Grease residue should never be poured down the sink or pouring receptacles.
H. Dishes must be rinsed sufficiently beforehand so that no food residue enters the dishwasher.
I. It is forbidden to throw objects or substances in the toilets that do not belong there (diapers, sanitary napkins, tampons, but also grease and food). Important: Only biodegradable products can be used for cleaning, as chemicals are harmful to the underground drainage system.
J. Smoking is not permitted inside the vacation home. For those wishing to smoke outside: please use the ashtray in the garden.
K. Please do not sit with wet bathing suits on the fabric sofas inside.
I.Animals are not allowed inside or in the garden, with the exception of guide dogs for people with disabilities. However, this must be reported to the owner in advance.
M. Outside there is a comfortable dining/picnic table and garden furniture; therefore please do not move furniture from indoors to outdoors (or vice versa), this also applies to television and audio equipment.
N. Own electrical devices must be technically sound and must not overload the electrical system.
O. It is forbidden to light fires or fireworks in the garden. It is forbidden to light candles in the house, but it is allowed on the terrace. It is forbidden to pitch tents, windbreaks or the like.
P. Use of the pool by children is permitted only under the strict supervision of parents/guardians.
Q. A first aid kit is available in the residence.
R.To prevent vermin or dirt from falling into the pool at night, but also for your own safety, the pool must be closed with the cover in the evening.
S. In rainy weather, it is necessary to store garden cushions in a dry place.
T. There is no access to the rooms which are locked: they are reserved for private use.
10) Liability/ Complaints/ Damages
A. The tenant is advised to check the premises and the inventory on arrival so that they can report any shortcomings or damages immediately. This prevents damage to the house, garden or contents from being incorrectly charged later.
B. The lessor declines all responsibility in the event of accident, theft, loss or damage of any kind during the stay. In this context, misuse of the railing on the deck in the central living area is not permitted (e.g. hanging, swinging, ...)
vs.The owner accepts no responsibility for failure of technical equipment, utilities, faulty operation or non-functioning of the internet. However, the lessor undertakes to do everything necessary to remedy the defects within a reasonable time.
D. The costs of normal maintenance and repair of defects are borne by the lessor. In the event of defects, the lessor must be informed so that he can take the necessary measures to remedy the problem.
E. A list of useful telephone numbers and addresses can be found in the information pack provided or online at www.magnoliavilla.be.
F. The owner provides an internet connection (wifi). However, the tenant must take into account the standards and regulations in force in France: it is strictly forbidden to download/upload or stream illegally on the internet. This is subject to heavy fines and strict controls. Tenants are responsible for their own internet usage. If fines are imposed, they will be passed on to the renter.The personal data of the renter/offender will be disclosed at the request of the authorities/authors/rights holders.
G. If the tenant nevertheless wishes to lodge a complaint, this must be sent in writing (or by e-mail) to the lessor within one week of departure from the holiday accommodation and must be substantiated.
H. The landlord is required to respect the privacy of tenants. However, if necessary, the lessor can enter his property to check the interior installations, the heating and the maintenance of the lawns. However, the tenant will be informed by telephone.
I. The owner is authorized to terminate any stay if the group is manifestly intolerant or does not respect the rules of life and good neighbourliness, without reimbursement of the rent paid.
11) Departure and final cleaning
The holiday home must be left as follows:- Leave the house clean - The ovens, the refrigerator, the dishwasher and the freezer are emptied and left clean by the tenants. - The barbecue is left clean (grid cleaned, no coals in the barbecue, etc.). - The stove and the sink must be left clean. - There are no more perishables left in the cupboards. - All kitchen utensils must be washed, dried and put back in place - Duvet covers and linens must be put in the washing machine. - Report any damage to the contact person or the owner - Empty the bins: important note: In the region of Haut-Vienne (Moissanes), there are strict regulations regarding the sorting of waste. Waste containers are located near the property. (See the information folder in the property) The tenant is responsible for any fines in the event of non-compliance with these regulations.
12) Applicable law
Only Belgian law is applicable to all of these conditions and provisions of the rental/house regulations as well as to the disputes arising therefrom.
